- The plaintiff hired the attorney, her good friend, to add her children’s names to the deed of her house. She says the defendant took forever to do it, but when she spoke with another attorney, they told her not to do that. She tried getting the deed changed, but now the defendant won’t give her a refund. The defendant argues he did a lot for her and has earned all the money she paid him.

Lolol! As a nys lawyer for many years, i wouldda count 350 singles plus tax, in front of her, stuff them in a brown paper bag and leave it on my desk for her to grab like all other crooked SI politicians do. While i observe her looking around for hidden cameras, of course.
My question to you, why was he procrastinating the process of the will and why wouldn't he give her the instructions just to get a signature of her son on the document, next time he comes, instead he chose to tell her he wasn't available for the day, well he could have done it the very next day, but did not.

Why did he procrastinate and kept stalling the simple procedure of getting her son's signature on the document. The judge even confirmed it, that her son's presence was not required while notarizing it, and his signature would do more than enough, but he never told her about that. Instead, both the times son came to the US from Mexico, the lawyer was not available. And when she wanted it to get it done, he went missing for two weeks of vacationing for thanksgiving. That old lady is more of a responsible person than this 50 yr old friend and a lawyer. Was he working out something by joining forces with the plaintiff's daughter, because I don't see any other reason for him stalling the will.

There used to be a saying, "If you wouldn't wear it to church, don't wear it to court". They both took it to heart.

I worked with a woman like this once. I quit partially bc of her. If someone talks to you with their eyes closed, RUN. They are all off.

@@jillianmizzen8850 no , a few years before by dad passed he wrote up a simple will , he had about 500 k in cash in the bank and never did a living trust and it worked out fine , no probate either because a year before he passed he put his children on his bank accounts as joint account holders . this experienced lawyer was mostly correct . this plaintiff only had ONE real asset , a house , and u dont really need to go though the trouble of trusts or probate if its just a house or less than a million bucks . he was right .

I’m an estate planning attorney, and this attorney is wrong on so many levels, from pricing to not doing a trust and advising her to add her children on her deed. So frustrating!

Not true about only needing a trust if you have a large amount of money. Not sure about all states but a Trust avoids probate. If you have real estate, definitely put it in a trust and the deed gets changed to the name of the trust. Now I believe it’s possible to pass on the property tax rate to children if they are named on the on the deed to avoid property tax reassessment. Tax laws keep changing so best to check with a CPA and an estate planner. I’m sure this is state dependent as well.
this experienced lawyer was correct . the simplest way with less than a million dollars is to simply have a will and add the names of any beneficiaries to your assets before u die and then everything will immediately go to the beneficiaries without probate .
@@marleonetti7 not in my state. A trust is the only way to avoid probate. Just completed my estate plan and my mom’s with an estate trial lawyer. Guessing it varies by state then.
So he was supposed to make himself available at a moments notice whenever your son decides to come to town?! Lol WEEKS after he's held these documents for you, while you've paid no retainers fee? Lol Ridiculous! You didn't come to him seeking advice, you came with your mind made up and asked for specific documents to be filed.

Talking with her eyes closed and at a 100mph. These types of personalities are hard to work with. I hope they don't go to the same church because by Sunday, the entire church will know her dirty laundry and how 'bad' of a lawyer he is. Also, how good of friends could they really be? If they were a friend of 30+ years, I wouldn't have charged them for such a small task.
Don't quote me but, I think I've read that adding names to a deed means those added then inherit the property at original value and therefore pay much higher capital gains when they sell. Whereas, if they just inherit, they do so at the current market value and so have much lower taxes. That's the main reason not to add a name to a deed but to a will, instead.

He seems very patient, and although he's a lawyer. I believe he's not pulling a full load, which makes it easy for him to deal with a damn fool.

Defendant is a lawyer and friend of the Plaintiff for the last 50 yrs, and he kept procrastinating her request over and over again with personal life excuses, BS. I would be pi55ed off at him for making my son travel to and fro from Mexico to US. He could have told her about his signature, why didn't he want to tell the plaintiff about the signature. Was the defendant playing a game and stalling the process of the will along with plaintiff's daughter, because he kept stalling her with excuses, everytime she visited, everytime she visited with her son. Sounds fishy to me.

She should have placed the property under a trust with her children as her successor trustee’s and beneficiaries of the trust. This would avoid them having any complications with being owners by simply placing them on the deed. Having the children inherit the property via a will is also still a process once she passes that can be avoided with a trust. Any knowledgable attorney/financial expert/ estate planner etc could have advised her of this, him mentioning unless she has 2-3 million dollars there is no need for a trust is false especially since he mentioned she has other properties as well.
Trust are more expensive and sometimes not an affordable option.
no , this experienced lawyer was correct . if there is only one asset involved and its less than a million dollars then trusts and probates are overkill and not necessary . a simple will and the adding of the names of the beneficiaries onto the deed , title , or bank accounts before death is all that is required for the beneficiaries to immediately inherit assets after the parents pass away .

I think her lawyer friend should have explained her options from the beginning: deed, will or trust and explained the differences. He could have had the papers ready for the son to sign while he was away. He took too long and she got confused about which option was best. I think the judge should have ruled in her favor.

Doing a Transferable upon death for home deeds makes so much more sense to me. You don't necessarily need a lawyer to file these for you. Having people added to the deed, aside from spouse, is something I would never do. So many things can go wrong especially if you're an older home owner.

The other lawyer is either poorly informed or just looking for some cash. A will is not a good idea. It takes a year or so to get anything. Use a trust. It’s immediate ownership.
my dad had a will and me and my sisters immediately inherited the 300 k he had in his bank accounts because he put our names on the accounts jointly with his about a year before he died . so no trust was needed .

what that second attorney said to her is true; do not put your children on the deed. What I found out goes with something dealing with a "tenent" situation....i can't remember. dang, I can't remember. My biggest concern for her is, in case she decided to get married to again and she passes away without a will the house will then go to the husband and not the children. Then when he passes away, he can be slick enough and passes it to his children; and now they lost their mom's legacy for them; even though she doesn't care what happens to it.

I like the fact the Plaintiff is sharp and highly intelligent. Meanwhile the Defendant was unsure, rusty and at times seemed to be rambling on and assuming.

The defendant which is the lawyer explained things clearly. The lady which is the plaintiff find another lawyer who was charging $50 less;soshe decided to change her mind.

Just cause someone else tells her “you shouldn’t do that) doesn’t mean she had to take his advice! Lawyers are sharks against each other period, but I don’t get why she has to throw their friendship away!!! No disagreement is worth dissolving a long-term friendship!!! None!!!

You put her house in a living trust and it doesn't have to go through probate. A will is still going to have to go through probate but not a living trust you transfer the house into the trust and all bank accounts
He prepared the paperwork for you he did some work and you backed out you really lost a friend because you’re so finicky and someone else made you change your mind and you wanted a refund . I would love to have a lawyer for a friend and you just screwed yourself and potentially your kids when you pass

It's called a Living Trust.
Says the lawyer has no evidence..Has evidence he made up...But claims her evidence...Things she made up (her writing things down) is evidence...I think she is in the wrong...If her kids were problems then sure...Putting their names on the deed is a bad idea...But if they are good kids then what is the worry? The odds of something happening is slim...And they save a lot of money by not going through probate...
